Terms of Service

By accessing or using the OnSand app and website ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

You must be at least 16 years old to use OnSand. By using our Services, you represent that you meet this age requirement.

If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (evest.io UG (haftungsbeschränkt), Karolinenstraße 21b, 13507 Berlin, Germany, Email: [email protected]) of your decision to withdraw by an unequivocal statement (e.g., a letter sent by post or email).

If you request that the provision of digital services begins during the withdrawal period, you acknowledge that you will lose your right of withdrawal once the service has been fully provided, provided you gave your prior express consent and acknowledgment that your right of withdrawal would be lost.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to keep this information up to date.

You must notify us immediately of any unauthorized use of your account.

You agree not to: use the Services for any unlawful purpose, harass, abuse, or harm other users, post false, misleading, or offensive content, attempt to gain unauthorized access to our systems, use automated means to access the Services without our permission, or interfere with the proper functioning of the Services.

You retain ownership of content you create on OnSand (such as game descriptions and profile information). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our Services.

We reserve the right to remove content that violates these terms or is otherwise objectionable.

OnSand provides tools to organize and find beach volleyball games. We are a platform and do not organize games ourselves. Participation in any game is at your own risk. We recommend appropriate warm-up and awareness of your physical condition before playing.

The OnSand name, logo, and all related marks, designs, and content are the property of evest.io UG (haftungsbeschränkt). You may not use our intellectual property without prior written consent.

Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

We are not responsible for the conduct of any user, the quality of any games organized through the platform, or any injuries or damages arising from participation in games.

To the maximum extent permitted by law, evest.io UG (haftungsbeschränkt) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim arising out of these terms shall not exceed the amount you paid us in the twelve months preceding the claim, or €100, whichever is greater.

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these terms or if we reasonably believe your actions may cause legal liability or harm to other users.

These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

If you are a consumer habitually resident in the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence. Nothing in these terms affects your statutory rights as an EU consumer under Directive 2011/83/EU (Consumer Rights), Directive 93/13/EEC (Unfair Contract Terms), or Directive (EU) 2019/770 (Digital Content and Digital Services).

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. However, we are required to inform you of the existence of this platform.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We may modify these terms at any time. We will notify you of material changes through the app or by email at least 30 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the new terms.
